The employee was exposed to struck by hazards, in that, training and education was not provided relating to safety requirements for trenching/excavating, to include at a minimum shoring and sloping requirements, the various types of soil classifications, and safe means of egress to and from a trench/excavation.

The trench measured approximately 25 feet in length, 5 feet wide and 6.5 feet deep where work was being performed.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On 4/13/2021, an employee of MTV Rental Properties LLC was working inside a trench located at 5 Green Ash Court, Troy, Missouri. The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that each employee working in an excavation was protected from engulfment hazards. The trench measured approximately 6.5 feet in depth, 5 feet in width and 25 feet in length where the employee was performing work.
