29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Bistro Line- On or about April 14, 2021, the employer failed to ensure that hazards created by moving parts on the rear side of the Colborne Double Shot Depositor #117795 were guarded to prevent injury to employees  b) Bistro Line- On April 23, 2021, the employer failed to ensure that hazards created by moving parts on the batter depositing side of the Colborne Double Shot Depositor #117795 were guarded to prevent injury to employees.  Employees were exposed to the moving parts while holding pans while they were filled.  No abatement certification or documentation is required for this item.

29 CFR  1904.29(b)(3): Each recordable injury or illness was not entered on the OSHA 300 Log and/or an accident report (OSHA Form 301 or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness has occurred:  On or about April 23, 2021, the employer did not enter the following workplace injury and illness on the OSHA 300 Log for the calendar year 2021:   a) On or about April 14, 2021, a recordable injury occurred when an employee was off of work following an injury to a hand that occurred when the employee's finger became caught in the moving parts of a machine.   No abatement certification or documentation is required for this item.
