29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).  On or about April 27, 2021, employees used an extension ladder at an angle such that the horizontal distance from the top support to the foot of the ladder (approximately 10 feet, 6 inches) is more than one-quarter of the working length of the ladder (approximately 4 feet).   No abatement certification or documentation required for this item.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about April 27, 2021, employees were exposed to fall hazards approximately 13 feet, 4 inches high while engaged in residential roofing activities.  Fall protection was not being utilized while performing roofing operations.     No abatement certification or documentation required for this item.  Francis Javier Serna dba F & F Construction and Roofing Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1502840, citation 2, item 1, and was affirmed as a final order on February 23, 2021, with respect to a worksite located at 244 E. First St., Hinsdale, IL.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder.  In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about April 27, 2021, at the above addressed jobsite, the portable ladder used to access the front roofing areas did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to fall hazards of approximately 10 feet, 6 inches.   No abatement certification or documentation required for this item.  Francis Javier Serna dba F & F Construction and Roofing Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1) which was contained in OSHA inspection number 1502840, citation 1, item 1, and was affirmed as a final order on February 23, 2021, with respect to a worksite located at 244 E.
