29 CFR 1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.   On or about April 27, 2021, the employer did not ensure that employees were in use of head protection while performing trenching work activities from inside of a trench with soil piles located on the edge of the trench. This exposed the employees to a struck-by hazards.

29 CFR 1926.651(j)(2):  Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.   On or about April 27, 2021, the employer did not ensure the excavated materials were kept at least 2 feet from the edge of the trench were an employee was working within the trench.  This exposed the employee to a struck-by hazard.

On or about April 27,2021, the employer did not ensure employees were protected from cave-ins while working within a trench with vertical walls. This exposed the employees to cave-in hazards.

On or about April 27, 2021, the employer did not ensure that the trench, employees were working within, was inspected by a competent person to identify hazardous conditions.  This exposed the employees to struck by and cave in hazards.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.     On or about April 27, 2021, the employer did not ensure a safe means to egress was provided to an employee working within a trench.  This exposed the employee to cave-in and fall hazards.
