29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. On the second floor, at the elevator landing, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 15, 2021, while conducting a drywall inspection, the employer exposed an employee to a 7 feet fall hazard over the top of the 2.2 feet high partial wall down to the steps of the main foyer stairs, in that the employee was not protected by a fall protection system and no top rail or baluster rail had been installed. b. On the second and third floor, at the elevator landing, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 19, 2021, while conducting a drywall inspection, the employer exposed an employee to a 19 feet and 29 feet fall hazard down the open elevator shaft, in that he was not protected by a fall protection system after removal of the guardrails by C & K Drywall Services, Inc. c. On the second and third floor, at the elevator landing, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or bout April 19, 2021, and at times prior, three drywall employees of C & K Drywall Services, Inc. were exposed to a 19 feet and 29 feet fall hazard down the open elevator shaft in that Moore Drywall, Inc. did not correct the fall hazard created by removal of the guardrails by C & K Drywall Services, Inc.
