29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part.  a) Andrew Byington LLC on or about April 27, 2021, at the site location of 12235 Bono Rd. Curtice, OH: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Andrew Byington LLC on or about April 27, 2021, at the site location of 12235 Bono Rd. Curtice, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems or alternative measures while performing roofing installation from elevated surfaces.  Employees working from atop a commercial structure roof were exposed to fall from height of 23 ft.

Curtice, OH: The employer did not provide head protection to employees tasked with clean up duties below other works performing roofing work from above, there by exposing them to struck by hazards.

29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a) Andrew Byington LLC on or about April 27, 2021, at the site location of 12235 Bono Rd. Curtice, OH: The employer did not ensure employees were protected from falls while performing work on a low-sloped roof. Employees conducting roofing work from atop a commercial structure were exposed to falls from heights of 23 ft.
