29 CFR 1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. On or about April 27, 2021, during the installation of masonry material for the construction of a restaurant located at 1822 Nagel Road, Avon, Ohio, the employer failed to ensure a JCB, Model 507-42 Telescopic Handler (Rough Terrain Forklift) used to support a scaffold platform (pallet) to lift an employee was specifically designed by the manufacturer for such use.

29 CFR 1926.602(d):Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter. 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about April 27, 2021, during the installation of masonry material for the construction of a restaurant located at 1822 Nagel Road, Avon, Ohio, the employer failed to ensure the operator of a JCB, Model 507-42 Telescopic Handler (Rough Terrain Forklift) was competent to operate a powered industrial truck safely by successfully completing powered industrial truck training and evaluation.
