29 CFR  1926.503(c):"Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where: (1) Changes in the workplace render previous training obsolete; (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; (3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  On or about April 28, 2021, during the installation of roofing material at a job site located at 430 W. Washington St, Medina, Ohio 44256, the employer did not ensure employees working on a steep pitched residential roof were protected from a fall of approximately 24.1 feet by utilizing a fall protection system.  Employees were trained but did not demonstrate the understanding and skill to recognize the hazard and implement a fall protection system to mitigate the hazard.

29 CFR  1926.1053(b)(9):The area around the top and bottom of ladders shall be kept clear.  On or about April 28, 2021 at the job site located at 430 W. Washington St, Medina, Ohio 44256; during the installation of roofing material on a residential roof, the employer did not ensure that employees utilized portable ladders that were clear of obstruction and trash at the bottom of the ladder while accessing and egressing from the ladder. The foreman was on site and utilizing the obstructed ladder to gain access to the elevated working surface.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  The employer does not protect each employee from eye injury caused by flying debris while performing roofing activities (installing material with hand tools) on residential homes and or structures by ensuring the use of eye protection while engaging in work activities. This most recently occurred on April 28, 2021 during the installation of roofing material at a job site located at 430 W. Washington St, Medina, Ohio 44256; the employer did not ensure employees working on the roof of a residential single family home were protected from possible danger of eye injury from impact, or from flying objects from the employees installing roofing material with hand tools.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from fall hazards while performing roofing activities on residential homes and or structures with unprotected sides and edges at height of approximately 24.1 feet above the ground by the use of guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on or about April 28, 2021, during the installation of roofing material at a job site located at 430 W. Washington St, Medina, Ohio 44256; employees are exposed to the hazard of falling approximately 24.1 feet to the ground while working on a roof of a single family home installing roofing material without the use of fall protection and or a fall protection system.

29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  On or about April 28, 2021, during the installation of roofing material on a residential single family home located at 430 W. Washington St, Medina, Ohio 44256, the employer did not conduct frequent and regular inspections of the job site where employees were exposed to fall hazards and struck by hazards while installing roofing material on a roof 24.1 feet above the ground.  The JMH Roofing LLC is owned and operated by the same owner operator as RAM Roofing LLC  (Jonas Hershberger) which was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.20(b)(2)), which was contained in OSHA inspection number 1392070, citation number 01, item number 01 and was affirmed as a final order on (5/10/2019), with respect to a workplace located at 5486 River Summit, N. Royalton, Ohio 44133.

On or about April 28, 2021, during the installation of roofing material on a residential single family home located at 430 W. Washington St, Medina, Ohio 44256, the employer did not ensure employees working on a lower section of the roof were protected from possible danger of head injury from impact due to falling or flying materials or debris from the upper working surfaces which were at a height of approximately 24.1 feet.  The JMH Roofing LLC is owned and operated by the same owner operator as RAM Roofing LLC (Jonas Hershberger) which was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.100(a) Head Protection), which was contained in OSHA inspection number 1392070, citation number 01, item number 01 and was affirmed as a final order on (5/10/2019), with respect to a workplace located at 5486 River Summit, N. Royalton, Ohio 44133.
