29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job sites, materials, and equipment to be made by a competent person(s). On or about May 1, 2018, and at times prior thereto, as a controlling and correcting employer for construction activities under the contract, the employer did not conduct frequent inspections and did not maintain programs and corrective actions to provide a workplace were workers employed in the performance of the contract were free from recognized hazards on the construction site: a) where workers using nail guns for framing activities were not wearing or provided eye protection, exposing them to being struck by flying objects, and b) where workers not wearing hardhats while working below other employees were exposed to a struck-by hazard from falling objects, and c) where workers performing framing activities without fall protection were exposed to a fall hazard at a height of over 20 feet to the ground below, and d) where workers exposed to fall hazards were not trained to recognize and avoid fall hazards, and e) where workers were not trained to recognize and avoid slip and fall hazards related to ladders and ladder safety.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about May 1, 2018, and at times prior thereto, as a controlling and correcting employer for construction activities under the construction contract, the employer did not provide instruction and controls to eliminate hazards and did not provide hazard recognition and avoidance training regarding safety precautions: a) where workers using nail guns for framing activities were not wearing or provided eye protection, exposing them to being struck by flying objects, and b) where workers not wearing hardhats while working below other employees were exposed to a struck-by hazard from falling objects, and c) where workers performing framing activities without fall protection were exposed to a fall hazard at a height of over 20 feet to the ground below, and d) where workers exposed to fall hazards were not trained to recognize and avoid fall hazards, and e) where workers were not trained to recognize and avoid slip and fall hazards related to ladders and ladder safety.
