29 CFR 1910.147(d): The established procedures for the application of energy control (the lockout or tagout procedures) was not done in sequence as required by 29 CFR 1910.147(d)(1) through (d)(6):   a. On or about June 5, 2021, employees were exposed to a caught in hazard while servicing a barrier gate that was stuck on the exit end of the CNS Mill. The employer did not ensure that energy control application steps were implemented as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of stored energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from the machine servicing hazard.

29 CFR  1910.147(c)(7)(i)(A):Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a. On or about June 5, 2021, employees were servicing a barrier gate that was stuck on the exit end of the CNS Mill. The employer did not ensure that the employees were trained on magnitude of the energy available on the equipment and on the methods and means necessary to isolate and control the pneumatic energy of the barrier gates.

Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.  a. On or about June 5, 2021, employees working at the CNS Mill and walking adjacent the exit end of the line were exposed to a crushed-by hazard between two pneumatic powered barrier gates.

29 CFR  1910.178(m)(5)(iii):When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement.  a. On or about May 24, 2021, an employee was standing in front of a Hyster S70FT propane powered forklift that had an elevated load of copper cathodes that was caught in a railcar. The employer did not ensure that the load was lowered and the rear wheels of the forklift were on the ground, thereby exposing the employee to a crushed-by hazard.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a. On or about April 19, 2021, employees were exposed to a pinch point hazard while operating the Block 2 welder as a result of inadequate guarding to protect employees from being caught-in the wire clamps.  b. On or about April 23, 2021, employees were exposed to a pinch point hazard while operating the Large Block welder as a result of inadequate guarding to protect employees from being caught-in the wire clamps.  c. On or about June 23, 2021, employees were operating the hydraulic wire cutter to cut copper wire in order to perform re-welds. The spring and whipping motion of the wire exposed the employees to a struck-by hazard.   d. On or about July 1, 2021, employees operating and making adjustments to the edge rolls on the CNS Mill were exposed to a caught in hazard as a result of unguarded rollers and pinch points.
