29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. a) 5038 Canterbury Road (Delaware Route 15) Felton, DE 19943: On or about April 29, 2021, the employer failed to ensure employees were provided any means to access the scaffold that was being used at the site. The scaffold was approximately 36 inches above a concrete surface but no means other than climbing and standing up on the scaffold were provided.

29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and/or steps were not parallel, level, and uniformly spaced when the ladder was in position for use: a) 5038 Canterbury Road (Delaware Route 15) Felton, DE 19943: On or about April 29, 2021, the employer failed to ensure employees using a ladder to support a scaffold was set up according to manufacturer's standards. The A-Frame ladder was closed and leaned against the wall with the scaffold placed between the ladders rungs/steps. The feet were not set flat to prevent the ladder from slipping out from the weight of the scaffold and personnel working on it.
