29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: (a) Calcon Constructors, Inc. at 1045 Overlook Drive, Lafayette, CO 80026: On and before April 22, 2021, the controlling employer did not ensure that a steel cable guardrail system that was erected by the steel erector around a second level floor opening, which measured approximately 8 feet 10 inches by 14 feet 4 inches, was capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge. A concrete subcontractor employee was injured and sustained serious injuries when he fell through the second level floor opening as a result of the steel cable guardrail system failing. This condition exposed subcontractor employees to fall hazards of approximately 13 feet.

29 CFR 1926.760(e)(2): Custody of fall protection. Fall protection provided by the steel erector that remains in the area where steel erection activity has been completed, to be used by other trades, at the direction of the controlling contractor or its authorized representative, was not inspected prior to accepting the fall protection system and authorizing persons other than steel erectors to work in the area: (a) Calcon Constructors, Inc. at 1045 Overlook Drive, Lafayette, CO 80026: On and before April 22, 2021, the controlling employer did not ensure that a proper inspection of the steel cable guardrail system that was erected by the steel erector around a second level floor opening, which measured approximately 8 feet 10 inches by 14 feet 4 inches, was conducted prior to authorizing and allowing trades other than steel erectors to work in the area. This condition exposed concrete subcontractor employees to fall hazards of approximately 13 feet.
