29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) Madison River Brewing Co, Inc., Belgrade Montana: On or about April 27, 2021, and at times prior, employees were exposed to a struck by hazards while working in and around storage racks that were not securely fastened to the floor. b) Madison River Brewing Co, Inc., Belgrade Montana: On or about April 27, 2021, and at times prior, employees were exposed to a struck by hazards while working in and around storage racks. The employer failed to identify the load rating of the racks to ensure they were not overloaded.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: a) Madison River Brewing Co, Inc., Belgrade Montana Mash Tun: On or about April 27, 2021, and at times prior, employees are exposed to the inability to self rescue in the event of oxygen deficient atmosphere and mechanical hazards while performing cleaning and maintenance operations inside permit required confined spaces. The employer did not implement and enforce the use of the permit required confined space program. a) Madison River Brewing Co, Inc., Belgrade Montana Brew Kettle: On or about April 27, 2021, and at times prior, employees are exposed to the inability to self rescue in the event of oxygen deficient atmosphere and mechanical hazards while performing cleaning and maintenance operations inside permit required confined spaces.
