29 CFR  OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards. :  a) Main Cooler: On or about  April 29, 2021, and at times prior,  employees were exposed to a struck by hazards while working in and around industrial steel storage racks that did not display a plaque designating load rating.  b) Dry Dock: On or about  April 29, 2021, and at times prior, employees were  exposed to struck by hazards while working in and around industrial steel storage racks that had damaged cross braces.  c) Dry Dock: On or about April 29, 2021, and at times prior, employees were exposed to struck by hazards while working in and around industrial steel storage racks that were not securely anchored to the floor.   d) Freezer: On or about  April 29, 2021, and at times prior,  employees were exposed to a struck by hazards while working in and around industrial steel storage racks that did not display a plaque designating load rating.  e) Freezer: On or about  April 29, 2021, and at times prior, employees were  exposed to struck by hazards while working in and around industrial steel storage racks that had damaged cross braces.

Stairs or a ramp must be provided where the exit route is not substantially level:  a) Raw Mixing Tanks:  On or about  April 29, 2021, and at times prior, employees were  exposed to entrapment hazards while working in and around the raw mixing tanks (HTST Machine) without an exit route free of obstruction.  The pathway was approximately 19.5" wide that lead to the supervisors office.

The employer failed to ensure that each container of hazardous chemicals in the workplace was labeled with the product identifier and words, pictures, symbols, or combination thereof, which provides at least general information regarding the hazards of the chemicals.  c) Maintenance Shop: On or about  April 29, 2021, and at times prior, employees were exposed to chemical hazards while working with chemicals such as but not limited to; Mineral Oil (Hydraulic Oil and Axel Oil), Petroleum distillates (Automatic Transmission Fluid and Hydraulic Fluid), and Petroleum (Hydraulic Fluid).  The employer failed to ensure that each container of hazardous chemicals in the workplace was labeled with the product identifier and words, pictures, symbols, or combination thereof, which provides at least general information regarding the hazards of the chemicals.  d) Engine Room: On or about  April 29, 2021, and at times prior, employees were exposed to chemical hazards while working with chemicals such as but not limited to; Tetrasodium EDTA (Conveyor Lubricant).
