29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section.  Location: 3420 Bedford Ave, Brooklyn, NY.  On or about 4/30/2021  a) Employees were not protected from falling while working from a supported scaffold platform located approximately 14 feet above ground.  The scaffold was not equipped with midrails.

29 CFR  1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below.  Location: 3420 Bedford Ave, Brooklyn, NY.  On or about 4/30/2021  a) The working platforms of the scaffold were not equipped with toeboards.  Masonry blocks, hand tools, and buckets of mortar were on the the scaffold platform.
