29 CFR  1926.602(c)(1)(vi):  Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks:   Worksite, 26 Mountainside Dr., Randolph, NJ  a) The employer elevated 4 workers approximately 20 feet from grade on a wooden pallet and plywood platform, placed onto the forks of a LULL Highlander 6648-42 Rough Terrain Forklift  to install a multi panel window onto the  Southeast 2nd floor (2nd window opening) of a residential building under construction.  The employer exited the cab while workers were still elevated and they were forced to jump from the platform when the truck rolled backwards, eventually striking a wall and tipping over.   ANSI B56.1-1969, Safety Standards for Powered Industrial Trucks requires that when leaving a Powered Industrial Truck unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shut off, brakes set, and the key or connector plug removed.    Violation occurred on or about April 30, 2021

29 CFR  1926.602(c)(1)(viii):  Whenever a truck is equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, the following additional precautions shall be taken for the protection of personnel being elevated:   (A) Use of a safety platform firmly secured to the lifting carriage and/or forks; (B) Means shall be provided whereby personnel on the platform can shut off power to the truck; (C) Such protection from falling objects as indicated necessary by the operating conditions shall be provide.   Worksite, 26 Mountainside Dr., Randolph, NJ  a) The employer elevated 4 workers approximately 20 feet from grade on a wooden pallet and plywood platform, placed onto the forks of a LULL Highlander 6648-42 Rough Terrain Forklift  to install a multi panel window onto the  Southeast 2nd floor (2nd window opening) of a residential building under construction.  The employer did not affix the work platform to the forklift blades during the operation.    b) The employer elevated 4 workers approximately 20 feet from grade on a wooden pallet and plywood platform placed onto the forks of a LULL Highlander 6648-42 Rough Terrain Forklift  to install a single panel window onto the rear or Southeast 2nd floor (4th window opening) of a residential building under construction.  The employer did not affix the work platform to the forklift blades during the operation.    c) The employer elevated 2 workers approximately 14 feet from grade on a job made wooden personnel platform to install 3 smaller windows on the 1st floor South side of a residential building under construction.  The employer did not affix the work platform to the forklift blades during the operation.  Violation occurred on or about April 30, 2021

29 CFR  1910.178(l)(1)(ii) as referenced by 29 CFR 1926.602(d): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).   Worksite, 26 Mountainside Dr., Randolph, NJ  a)  The employer/operator was not trained on the safe use and operation of a LULL Highlander 6648-42 Rough Terrain Forklift which was used to elevated 2-4 workers approximately 14-20 feet from grade on a job made wooden personnel platform and a wooden pallet/plywood platform, placed onto the forks to install windows onto the  Southeast 1st and 2nd floors of a residential building under construction.  During the operation the work platforms were not secured to the forklift blades and fall protection was not provided.  In addition, the operator exited the cab while employees were elevated allowing the the forklift to roll backwards and forcing them to jump from the platform  before the forklift eventually hit a wall and tipped over.  Violation occurred on or about April 30, 2021

29 CFR  1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:   Worksite, 26 Mountainside Dr., Randolph, NJ  a)  The employer elevated 4 workers approximately 20 feet from grade on a wooden pallet and plywood platform, placed onto the forks of a LULL Highlander 6648-42 Rough Terrain Forklift  to install a multi panel window onto the  Southeast 2nd floor (2nd window opening) of a residential building under construction.
