29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On or about May 5, 2021, the information sticker with the lift capacity for the Mitsubishi model FGC70K forklift was not updated in that it listed only the lift capacity of the forklift while lifting pallets, not for when it lifted granite slabs.

29 CFR 1910.178(a)(5):If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered. On or about May 5, 2021, the information sticker with the updated forklift capacity for the Mitsubishi model FGC70K forklift was not updated in that the serial number for the spreader bar model did not match the one listed on the information sticker.

Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace: 29 CFR 1910.178(l)(3)(ii)(D):Pedestrian traffic in areas where the vehicle will be operated; On or about May 5, 2021 the training program content for operators was not adequate in that as part of workplace related topics pedestrian traffic in the area where the vehicle was operated allowed pedestrians to walk beside or in front of the moving forklift to spot granite slabs, exposing pedestrians to being struck by the moving forklift.

On or about May 3, 2021, employees were allowed to stand under the elevated forks for the Mitsubishi model FGC70K forklift while it was loaded with granite slabs to guide the slabs on the forklift's path of travel while moving to different locations within the warehouse

29 CFR 1910.178(n)(6):The driver shall be required to look in the direction of, and keep a clear view of the path of travel. On or about May 3, 2021, the forklift operator for the Mitsubishi model FGC70K forklift did not keep a clear view of the path of travel in that an employee holding the granite slab hanging from the hoist attachment was struck by the forklift while trying to correct the granite slab position.
