29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) On or about May 5, 2021 at the worksite located at 1777 Wisconsin Ave, Grafton, WI, the employer did not ensure training in hazardous communication was performed for all employees who perform work tasks with helium, thereby exposing workers to potential health hazards including, but not limited to, oxygen displacement and frostbite.

29 CFR 1910.101(b):The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: (a) On or about May 5, 2021 at the worksite located at 1777 Wisconsin Ave, Grafton, WI, the employer did not ensure compressed helium gas was used in accordance with the Compressed Gas Association Pamphlet P-1-1965, Section 3 "Safe Handling of Compressed Gasses." (b) On or about May 5, 2021 at the worksite located at 1777 Wisconsin Ave, Grafton, WI, the employer did not ensure compressed helium gas stored in cylinders was in accordance with the Compressed Gas Association Pamphlet P-1, Section 5.8, Safe Handling of Containers, in that helium cylinders were transported via hand truck without being properly secured to the unit, thereby exposing workers to helium-related injuries and illnesses. (c) On or about May 5, 2021 at the worksite located at 1777 Wisconsin Ave, Grafton, WI, the employer did not ensure compressed helium gas stored in cylinders was in accordance with the Compressed Gas Association Pamphlet P-1, Section 5.8.4, Cylinder Positions in Storage, in that a bungee cord combined with a chain was used to secure tanks from falling or rolling, thereby exposing workers to helium-related injuries and illnesses. (d) On or about May 5, 2021 at the worksite located at 1777 Wisconsin Ave, Grafton, WI, the employer did not ensure compressed helium gas stored in cylinders was in accordance with the Compressed Gas Association Pamphlet P-1, Section 5.8.4, Cylinder Positions in Storage, in that approximately two cylinders of helium were maintained in the front of the store with an inadequate means of securement. In the area where balloons are filled with helium, two compressed helium gas cylinders were stored in a cabinet system where the outer door was secured by a small magnet and inner partition inadequately suited to prevent the displacement of the cylinders, thereby exposing workers to helium-related injuries and illnesses. Dollar Tree Stores, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.101(b), which was contained in OSHA inspection number 1183553, citation number 02, item number 02 and was affirmed as a final order on March 27, 2017, with respect to a workplace located at 1327 Main St., Billings, MT 59105. Dollar Tree Stores, Inc. was previously cited for a violation of this occupational safety and health standard, 29 CFR 1910.101(b), which was contained in OSHA inspection number 1206871, citation number 1 item number 1 and was affirmed as a final order on July 11, 2017, with respect to a workplace located at 727 N Charles St., Warrensburg, MO 64093. Dollar Tree Stores, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.101(b), which was contained in OSHA inspection number 1501569, citation number 03, item number 01 and was affirmed as a final order on May 3, 2021, with respect to a workplace located at 1707 East Houston St., Cleveland, TX 77327.
