29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazardous chemical splashes, chemical burns, third degree chemical burns, and struck-by hazards while using a hose to transfer hazardous chemicals from bulk storage to smaller containers:  a)At the facility, Union Avenue & DuBois Street Old Liquid Room: An employee was sprayed by a corrosive chemical (Rustex; pH 2) and was struck by a camlock hose fitting when a Kentax polyvinyl chloride (PVC) inner and outer tube with polyester textile yarn hose and fittings at each end, failed while transferring the chemical from a partially full 900-gallon vertical bulk storage tank, into a smaller container. The hose contained a residual chemical from a prior transfer of an incompatible chemical. The employee suffered chemical burns to the face and laceration to the face from the hose fittings, on or about 5/6/2021.

29 CFR  1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition:  a) At the facility, Union Avenue & DuBois Street Liquid Room: Several PVC transfer hoses were scattered on the floor, throughout the work area, exposing employees to trip, slip and fall hazards. The employer did not ensure that walking working surfaces, were kept orderly, thus exposing employees to trip, slip and fall hazards, to the same surface, on or about 5/6/21.

The low pressure on the right hand side of the eyewash station affected the flow of flushing fluid. The employer did not provide a suitable eyewash station to ensure that the eyewash station was capable of providing controlled flow of flushing fluid to both eyes simultaneously, on or about, 7/26/21.

29 CFR  1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) At the facility, Union Avenue & DuBois Street Liquid Room: An employee was splashed with Rustex, which resulted in a chemical burn to the face, was not wearing a face shield. The employer did not ensure that an employee was wearing appropriate eye and face protection, while handling corrosive chemicals, on or about 5/6/21.  Diamond Chemical Company, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.133(a)(1), which was contained in OSHA inspection number 1351835, citation number 01, item number 2B and was affirmed as a final order on 3/5/19, with respect to a workplace located at, Union Avenue & DuBois Street, East Rutherford, New Jersey.
