29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  On or about May 6, 2021, the employer did not provide a medical evaluation to determine each employee's ability to use a N95 filtering facepiece respirator before requiring the use. The employer required employees to wear N95 filtering facepiece respirators while mixing paste and cleaning on the second level above the core machines to protect against potential exposure to respirable crystalline silica.  Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

The employer required employees to wear N95 filtering facepiece respirators to protect against respirable crystalline silica while mixing paste and cleaning on the second level above the core machines.

29 CFR  1910.134(k)(1): The employer did not provide effective training that covered the required elements in 1910.134(k)(1)(i) - (vii):   On or about May 6, 2021, the employer did not provide employees with effective training on why the respirator is needed and how improper fit, usage, or maintenance can compromise the protective effect of the respirator, how to check the seal of the respirator, when to replace the respirator. The employer required employees to wear N95 filtering facepiece respirators while mixing paste and cleaning on the second level above the core machines to protect against potential exposure to respirable crystalline silica.

29 CFR  1910.1053(j)(3)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the following: (A) the health hazards associated with exposure to respirable crystalline silica; (B) specific tasks in the workplace that could result in exposure to respirable crystalline silica; (C) specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used; (D) the contents of this section; and, (E) the purpose and a description of the medical surveillance program required by paragraph (i) of this section:   On or about May 6, 2021, the employer did not ensure that employees working in the core and paste areas of the facility with potential exposure to respirable crystalline silica were provided effective training on the hazards associated with exposure, job tasks which could result in exposure, controls in the workplace to limit exposure, and the contents of the  OSHA respirable crystalline silica standard.
