29 CFR 1910.28(b)(15):Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking/working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii): Or in the alternative: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall hazards while working on a bin conveyor at a height of approximately 16 feet: (a) On April 20, 2021 and times prior for the employees exposed to fall hazards while riding a conveyor to a height of approximately 16 feet, to access the limit switches of an elevated conveyor system to conduct maintenance at or near 3630 Gateway Drive in Grand Forks, North Dakota. Note: Among other methods, one feasible and accepted method to correct this hazard would be to follow the warnings contained in the manufacturer's manual and industry consensus standards such as ASME B20.1 - 2012 and to provide a safe, effective means for accessing conveyor systems for the purpose of maintenance and repair through the use of mobile work platforms or ladders.

29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA: (a) On or about April 20, 2021 for the employee of J.R. Simplot Company, whose hospitalizing injury was not reported to the Occupational Safety and Health Administration within 24 hours, at or near 3630 Gateway Drive in Grand Forks, North Dakota.
