29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  The employer is failing to implement an effective hearing conservation program that complies with the standard for employee noise exposure exceeding an 8-hour time-weighted average of 85 A-weighted decibels (dBA). On or about May 20, 2021, an employee in Processing was exposed to an 8-hour time-weighted average of 87.2 dBA or 67.8% of the equivalent dose for the sampling period of 458 minutes. A zero increment was included for the 22 minutes not sampled. The exposure levels of other Processing and Maintenance employees also equaled or exceeded 85 dBA.

29 CFR  1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:   The employer is failing to develop and implement a noise monitoring program to determine employee noise exposure. On or about May 20, 2021, an employee in Processing was exposed to an 8-hour time-weighted average of 87.2 dBA or 67.8% of the equivalent dose for the sampling period of 458 minutes. A zero increment was included for the 22 minutes not sampled. The exposure levels of other Processing and Maintenance employees also equaled or exceeded 85 dBA.
