29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section: a) Lot 641 of the Bishops Landing Development in Millville, DE 19967: On or about May 6, 2021, the employer failed to ensure employees conducting framing work on a new multi-story construction property while being unprotected in all directions, approximately 10 feet above grade, were provided adequate fall protection.

29 CFR 1926.1053(b)(13):The top or top step of a stepladder was used as a step: a) Lot 641 of the Bishops Landing Development in Millville, DE 19967: On or about May 6, 2021, the employer failed to provide a ladder high enough for the employees to appropriately climb and step off onto the surface. There was only a 8 foot step ladder at the site for employees to gain access to the second floor 10 foot above the lower surface requiring employees to step onto the top step and top of that ladder to gain access to the upper level.
