29 CFR  1926.20(b)(2): General safety and health provisions. Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a)  On or about 05/06/2021 )  there was no frequent and regular inspection program being maintained in use by a competent person to ensure the job site, material, equipment and surrounding work environment  were safe; such as electrical power lines were still energize within close proximity of the working area.

29 CFR  1926.416(a)(3): General requirements. Protection of employees. Before work is begun the employer shall ascertain by inquiry or direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, is so located that the performance of the work may bring any person, tool, or machine into physical or electrical contact with the electric power circuit. The employer shall post and maintain proper warning signs where such a circuit exists. The employer shall advise employees of the location of such lines, the hazards involved, and the protective measures to be taken.  a)  On or about 05/06/2021, an employee was exposed to energized power lines while operating an aerial boom man-lift to power wash the side of a commercial building as part of the preparation of the wall for exterior painting.

29 CFR  1926.453(b)(2)(ii): Aerial lifts. Specific requirements. Extensible and articulating boom platforms. Only authorized persons shall operate an aerial lift.  a) On or about 05/06/2021, the Sunbelt Rentals' aerial lift was not operated by authorized employees, in that the operators' manual was not reviewed and the location of the electrical lines were not determined prior to operating the aerial lift.
