29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a) Service Bay, I-90 Motors, Inc. dba I-90 Motors & RV: On or about May 11, 2021 and at times employee(s) were exposed to respiratory hazards while painting and performing fiber glass repair while using full face respirators with combination filters. The employer failed to ensure that employees voluntarily wearing respirators were medically evaluated prior to permitting their use.

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. a) Service bay, I-90 Motors, Inc. dba I-90 Motors & RV: On or about May 11, 2021 and at times prior employees were exposed to chemical hazards while working with chemicals such as but not limited to; Ethylene glyclol-n-butyl ether, Benzenemethanol (Goof Off Gunk & Adhesive Remover). The employer failed to ensure that each container of hazardous chemicals in the workplace was labeled with the product identifier and words, pictures, symbols, or combination thereof, which provides at least general information regarding the hazards of the chemicals.
