29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Binney Water Treatment Plant, 5070 S. Robertsdale Way, Aurora CO 80016: On or about May 11, 2021, and at times prior, employees were potentially exposed to crushing, suffocation, and struck-by hazards while working in trenches which were not protected from cave-ins by an adequate protective system. An employee was struck by a 36 inch wide steel water pipe when the side of the trench caved in, shifting the pipe and pinning the employee to the side of the trench.

29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Binney Water Treatment Plant, 5070 S. Robertsdale Way, Aurora CO 80016: On or about May 11, 2021, and at times prior, employees were potentially exposed to crushing, suffocation, and struck-by hazards while working in trenches which had not been inspected by a competent person. An employee was working in a trench which had not been inspected by a competent person after soil conditions changed due to recent rainfall. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certificate of Corrective Action Worksheet).
