29 CFR 1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: On 5/11/2021 the employer permitted Home Health Aides to wear a 3M N-95 filtering facepiece respirator to protect against the SARS-CoV-2 virus while providing support services to residents. The employer did not provide employees with the information contained in appendix D. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY.
