29 CFR 1926.1053(b)(4):Ladders were used for purposes other than the purpose for which they were designed: (a) S & B Johnston Painting, LLC at 2801 Moss Stone Circle, Sioux Falls, SD 57110: On or about and at times prior to May 12, 2021, the employer did not ensure that ladders that were being utilized on site were being used for which they were designed in that an employee was leaning the seven foot A-framed ladder against the wall of the residential property on the roof for access to the second level dormer for painting operations. This condition exposed the employee to a fall hazard to the roof of the property.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards: (a) S & B Johnston Painting, LLC at 2801 Moss Stone Circle, Sioux Falls, SD 57110: On or about and at times prior to May 12, 2021, the employer did not ensure that each employee utilizing ladders had been trained to recognize the hazards associated with working with and on ladders. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The condition exposed employees to the hazard of falling from elevations over 11 feet.
