29 CFR 1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. The employer is failing to protect employees from eye injuries associated with operating pneumatic nail guns. This was most recently documented on or about May 13, 2021 at a residential construction jobsite located at 11961 S 113th Ave., Papillion Nebraska. Employees were operating pneumatic nail guns while shingling a roof without the use of eye protection.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system. The employer is failing to protect employees from fall hazards when conducting roofing operations on a residential structure. This was most recently observed on or about May 13, 2021 at 11961 S 113th Ave., Papillion Nebraska, 68046. Four employees were working on the roof of a newly constructed residential home at heights of over 6 feet and not utilizing any form of fall protection.
