29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Jobsite: On or about May 13, 2021, three employees were working an approximately 17 foot deep excavation and they were not protected from a cave-in. The employees were working inside a manhole box but there was approximately 7 feet of unprotected vertical sidewalls above and beside the manhole box.

29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) Jobsite: On or about May 13, 2021, the competent person did not remove the employees who were working in an approximately 17 foot deep excavation that was not properly shored nor sloped. There was about 7 feet of vertical sidewall above the steel manhole box.

29 CFR 1926.1052(c)(1)(ii):Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge: (a) Jobsite: On or about May 13, 2021, employees were using a set of steps (4 risers) that had an open side to the excavation. The fall hazard into the excavation was approximately 10 feet.
