29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. A Cook working in Kettle Kitchen was exposed to a noise dose of 108.5%, or an equivalent dBA of 90.5 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 426 minutes during one shift on May 25, 2021. The employer did not have a continuing, effective hearing conservation program. b. A Cook working in PC Fryer was exposed to a noise dose of 113.8%, or an equivalent dBA of 90.9 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 423 minutes during one shift on May 25, 2021. The employer did not have a continuing, effective hearing conservation program. c. A Cook working in PC Fryer was exposed to a noise dose of 132.6%, or an equivalent dBA of 92 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 419 minutes during one shift on May 25, 2021. The employer did not have a continuing, effective hearing conservation program. d. A Cook working in Kettle Kitchen was exposed to a noise dose of 133.5%, or an equivalent dBA of 92 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 354 minutes during one shift on May 25, 2021. The employer did not have a continuing, effective hearing conservation program. e. A Cook working in Kettle Kitchen was exposed to a noise dose of 144.9%, or an equivalent dBA of 92.6 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 424 minutes during one shift on May 25, 2021. The employer did not have a continuing, effective hearing conservation program. f. A Packer working in PC Fryer was exposed to a noise dose of 135.0%, or an equivalent dBA of 92.2 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 417 minutes during one shift on May 25, 2021. The employer did not have a continuing, effective hearing conservation program. g. A Packer working in PC Fryer was exposed to a noise dose of 78.0%, or an equivalent dBA of 88 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 278 minutes during one shift on May 26, 2021. The employer did not have a continuing, effective hearing conservation program.
