29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or caught-in between operating motor vehicles and equipment: a) Paving job for Georgetown Municipality - South Front Street between West Pine Street and West Adams Street, in Georgetown, DE 19947 - Both lanes in a road closure: On or about 5/13/2021, Employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed flagging operations and other operations to facilitate site paving operations without the use of a properly communicated traffic control plan and internal traffic control plan.

29 CFR 1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazards: a) Paving job for Georgetown Municipality - South Front Street between West Pine Street and West Adams Street, in Georgetown, DE 19947 - Both lanes in a road closure: On or about 5/13/2021, Employees were exposed to multiple hazards onsite including but not limited to struck by/ caught in hazards when they performed paving work, when signs were not posted and flaggers were used to assist trucks in delivering materials effectively closing the road both directions.
