29 CFR 1910.146(c)(6): When there were changes in the use or configuration of a non-permit confined space that could increase the hazards to entrants, the employer did not reevaluate that space and, when necessary, reclassify it as a permit-required confined space: On or about May 11, 2021, the employer changed the configuration of a non-permit confined space when the opening into the scale pit was resealed with refractory brick. The scale pit no longer had proper access and egress. The employer made no attempt to reevaluate the space when changes occurred to the configuration of a non-permit required space.
