1926.20(b)(2) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On January 12, 2021, frequent and regular inspections of the P2 parking garage did not ensure that the cover over the duct shaft opening was continuously remarked and secured in place during construction.

29 CFR 1926.502(a)(2):Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On or before January 12, 2021 employees were exposed to fall potentials in excess of 10 feet during the course of a new construction apartment complex parking garage, located in the north east area of P2 where employees were working adjacent to an approximate 4 foot x 4 foot unsecured covered mechanical duct work floor hole without fall protection systems which comply with Subpart M being provided or maintained before employees began that work which necessitated such protection.

On or before January 12, 2021 employees were exposed to fall potentials in excess of 10 feet during the course of a new construction apartment complex parking garage, located in the north east area of P2 there was an approximate 4 foot x 4 foot mechanical duct work floor hole cover which was not secured to prevent construction equipment or employee activities and maintained so as to continually prevent accidental displacement.
