29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Dominguez Construction, LLC located at 7474 Park Bend Drive, Westerville, OH 43082: On and preceding May 18, 2021, employees were installing roofing shingles and other materials for a re-roof project on a two story residential home at heights up to 25 feet without fall protection, Personal protective equipment (PPE) and using improperly configured ladders for access/egress from the roof. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Dominguez Construction, LLC located at 7474 Park Bend Drive, Westerville, OH 43082: On and preceding May 18, 2021,  the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Roofers were installing shingles and other materials on a roof that varied from 10-25 feet. The employees were not utilizing proper fall protection which exposed them to falls up to 25 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) Dominguez Construction, LLC located at 7474 Park Bend Drive, Westerville, OH 43082: On and preceding May 18, 2021,  the employer did not ensure that the extension ladders used to access the roof extended at least 3 feet beyond the upper landing. Employees were utilizing an extension ladder to access the lower roof with the side rails extending 12 inches beyond the upper landing. The following condition exposed employees to falls up to 20 feet.
