29 CFR  1910.147(c)(1):  Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  The employer failed to develop and document a Hazardous Energy Control Program to include energy control procedures, employee training, and periodic inspections when employees were performing servicing and maintenance activities.

29 CFR  1910.147(c)(4)(i):Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.  (a) The employer did not develop and document energy control procedures when performing maintenance and servicing activities on equipment such as but not limited to: Strojarne Piesok Hydraulic Press Brake, Plasma table, Pacific Shear, and FMB horizontal band saws.    (b) The employer did not develop and document die setting procedures for the hydraulic press brake which provided exclusive control of the hazardous motion exposing employees to crushing hazards.

29 CFR  1910.147(c)(7)(i)(B):Each affected employee shall be instructed in the purpose and use of the energy control procedure.  Affected employees were not trained in the control of hazardous energy to be able to recognize lockout/tagout devices immediately, recognize when the energy control procedure was being used, understand the purpose and use of the procedure, and understand the importance of not tampering with lockout or tagout devices and not starting or using equipment that has been locked out or tagged out.

29 CFR  1910.178(q)(6):  Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.  The Toyota propane forklift, which was originally outfitted with a seat belt, did not have the seat belt installed exposing employees to tip over hazards.

29 CFR  1910.179(j)(3):  Periodic inspection. Complete inspections of the crane shall be performed at intervals as generally defined in paragraph (j)(1)(ii)(b) of this section, depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (j)(2) of this section and in addition, the following items as outlined in 29 CFR 1910.178(j)(3)(i) to (x). Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard.   The Demac 2 Ton Capacity overhead crane or 2 Ton Coffing overhead crane and 5 Ton Coffing overhead cranes were not inspected on a monthly to annual basis based on the nature of the critical components of the crane and the degree of their exposure to wear, deterioration, or malfunction exposing employees to struck by hazards.

29 CFR  1910.184(e)(1): Sling identification. Alloy steel chain slings shall have permanently affixed durable identification stating size, grade, rated capacity, and reach.   In the Front Shop area by the burn table, a 27" long steel sling with sheet hook attachment did not have tags to identify the capacity, size, and reach.

29 CFR  1910.184(e)(3)(i):  In addition to the inspection required by paragraph (d) of this section, a thorough periodic inspection of alloy steel chain slings in use shall be made on a regular basis, to be determined on the basis of (A) frequency of sling use; (B) severity of service conditions; (C) nature of lifts being made; and (D) experience gained on the service life of slings used in similar circumstances. Such inspections shall in no event be at intervals greater than once every 12 months.  Inspection of the slings used in the facility were not conducted on a periodic basis, no greater than every 12 months, to ensure worn slings and attachments or those with damage such as cracks, kinks, bends, cuts, gouges, and frayed fibers were removed from service.

29 CFR  1910.212(a)(1):  Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  (a)  The "Yellow" upright sander had the side open to in-running nip points from the belt exposing employees to caught between hazards.  (b)  The Baldor Grinder Buffer / upright sander had the side open to in-running nip points from the belt exposing employees to caught between hazards.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about May 18, 2021, the Strojarne Piesok Hydraulic Press Brake utilized a foot pedal for activation and did not guard the point of operation exposing employees to struck by hazards.

On or about the week of April 26, 2021, in the Front Shop, employees utilized a Makita angle grinder to make straight cuts without the guard exposing employees to struck by hazards.
