29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Gramajo Construction at 4801 Homestead Street, Rapid City, SD 57703:  On or about and at times prior to May 18, 2021, the exposing employer did not ensure that employees were properly trained in the recognition and avoidance of unsafe conditions.  This condition exposed employees  to various hazards associated to but not limited to, ladder and fall hazards due to lack of training and the control or elimination of the hazards.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  a) Gramajo Construction at  4801 Homestead Street, Rapid City, SD 57703:  On or about and at times prior to May 18, 2021 the exposing employer did not ensure that employee training had been documented prior to employees were exposed to fall hazards.  This condition exposed employees to fall hazards due to the employees not being property trained and documented to correct hazards.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  a) Gramajo Construction at 4801 Homestead Street, Rapid City, SD 57703:  On or about and at times prior to May 18, 2021, the exposing employer did not ensure that employees were trained on the use of portable ladders being used on site.  This condition exposed employees to fall and other hazards associated with improper ladder use.

29 CFR  1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) Gramajo Construction at 4801 Homestead Street, Rapid City, SD 57703:  On or about and at times prior to May 18, 2021, the exposing employer did not ensure that employees were protected from falls in that employees were conducting roofing operations on a commercial apartment complex (building #1 - 5015) with no fall protection in place.  This condition exposed employees to fall hazards of greater than 23 feet.  b) Gramajo Construction at 4801 Homestead Street, Rapid City, SD 57703:  On or about and at times prior to May 18, 2021, the exposing employer did not ensure that employees were protected from falls in that employees were conducting roofing operations on a commercial apartment complex (building #2) with no fall protection in place.  This condition exposed employees to fall hazards of greater than 9 feet.  c) Gramajo Construction at 4801 Homestead Street, Rapid City, SD 57703:  On or about and at times prior to May 18, 2021, the exposing employer did not ensure that employees were protected from falls in that employees were conducting roofing operations on a commercial apartment complex (building #3 - 4707) with no fall protection in place.  This condition exposed employees to fall hazards of greater than 17 feet.  Gramajo Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1280261, citation number 1, item number 1 and was affirmed as a final order on February 9, 2018, with respect to a workplace located at Willow Lakes Golf Course, Offutt AFB, NE 68113.
