29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Jose Lopez, at a jobsite located at 117 Heron Avenue, Lot HRM 137, Pataskala, Ohio 43062: On and/or preceding May 20, 2021, the employer did not maintain a safety and health program such as but not limited to a personal protective equipment program or a fall protection program to ensure detection and correction of hazards during construction activities.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Jose Lopez, at a jobsite located at 117 Heron Avenue, Lot HRM 137, Pataskala, Ohio 43062: On and/or preceding May 20, 2021, the employer failed to ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Employees were using a pneumatic nail guns while roofing a house. The employees were not utilizing eye protection, thereby exposing employees to struck-by hazards to the eyes.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Jose Lopez, at a jobsite located at 117 Heron Avenue, Lot HRM 137, Pataskala, Ohio 43062: On and/or preceding May 20, 2021,the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing a new construction single family house. The employees did not have any means of fall protection, thereby exposed to fall hazards of up to 20 feet.
