29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a.) On September 14, 2021, the operator working the dewatering screen platform in the Micro-Fines Plant, was exposed to continuous noise levels at 89.1% of the permissible daily action level(8-hour, time-weighted average of sound level of 85dbA or equivalently, a dose of 50 percent), during the 480 minute sampling period. b.) On September 14, 2021, the Micro-Fine Plant employee was exposed to continuous noise levels at 116.0% of the permissible daily action level (8-hour, time-weighted average of sound level of 85dbA or equivalently, a dose of 50 percent), during the 480 minute sampling period. c.) On September 14, 2021, the employee operating the polishing table in the Micro-Fines Plant, was exposed to 121.1% of the permissible daily action level (8-hour, time-weighted average of sound level of 85dbA or equivalently, a dose of 50 percent) during the 475 minute sampling period. d.) On September 14, 2021, the maintenance employee was exposed to continuous noise levels at 67.4% of the permissible daily action level (8-hour, time-weighted average of sound level of 85dbA or equivalently, a dose of 50 percent) during the 469 minute sampling period.
