29 CFR  1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:   On or about 05/11/2021 and at times prior, on a residential property located at 4722 Villa Mare Lane, Naples FL, 34103, the employer did not ensure that employees completed a web-based fall protection training that would enable the employees to become familiar with the use and operation of personal fall arrest systems during solar systems installation.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall:   On or about 05/11/2021 and at times prior, on residential property located at 4722 Villa Mare Lane, Naples FL, 34103, employees engaged in new solar system installation were exposed to a fall hazard of approximately 18 feet while climbing up/down an extension ladder and carrying objects such as solar panels measuring 67" x 40"; and buckets or bags filled with tools and materials that could result in them losing their balance and falling.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about 05/11/2021 and at times prior, on the roof of a residential property located at 4722 Villa Mare Lane, Naples FL, 34103, employees were exposed to a fall hazard of approximately 18 feet while engaged in tiles replacement for a new solar system installation in that employees were not using any means of fall protection.  Marc Jones Construction LLC dba Sunpro Solar was previously cited before for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(13), which was contained in OSHA Inspection Number 1461427, Citation Number 1, Item Number 1, and was affirmed as a final order on 04/23/2020, with respect to a workplace located at 10432 Aphrodite Dr, El Paso, TX 79924.  Marc Jones Construction LLC dba Sunpro Solar was previously cited before for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1489121, Citation Number 2, Item Number 1, and was affirmed as a final order on 01/28/2021, with respect to a workplace located at 6906 Hibiscus Falls, San Antonio, TX 78218.
