29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact or from falling or flying objects or from electrical shock and burns were not protected by protective helmets:   (a)J and L Construction, LLC at 16677 437th Avenue, Wallace, SD 57272: On or about and at times prior to May 21, 2021, the exposing employer did not ensure employees were protected from head injuries. Employees were engaged in tear-off operations on a single family home with multiple level roofs. Employees were working below the main roof while tear-off work was being conducted above without the use of protective helmets. This condition exposed employees to head injuries.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:  (a)J and L Construction, LLC at 16677 437th Avenue, Wallace, SD 57272: On or about and at times prior to May 21, 2021, the exposing employer did not ensure the employees were protected from injury in that, employees were engaged in roofing activities on a 9-in-12 pitched roof and were not using a fall protection system. Employees were working on the roof conducting re-roofing operations on a single-family home without the use of a fall protection system. This condition exposed employees to fall hazards of approximately 10 and 18 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  (a)J and L Construction, LLC at 16677 437th Avenue, Wallace, SD 57272: On or about and at times prior to May 21, 2021, the exposing employer did not ensure that each employee engaged in roofing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees engaged in roofing activities worked near the edge of a two story roof on a residential home without the use of a fall protection system. This condition exposed employees to a fall in excess of 18 feet.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a)	The nature of fall hazards in the work area; b)	The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)	The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other          protection to be used;  d)	The role of each employee in the safety monitoring system when this system is used; e)	The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)	The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)	The role of employees in fall protection plans; h)	The standards contained in this subpart.  Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.

The condition exposed employees to an uncontrolled fall hazard of approximately 10 feet.

This condition exposed the employees to a fall hazard of up to approximately 10 feet.  Abatement Note:  The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:  (a)	The nature of fall hazards in the work area;  (b)	The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used;  (c)	The proper construction, use, placement, and care in handling of all stairways and ladders;  (d)	The maximum intended load-carrying capacities of ladders; and  (e)	The standards contained in this subpart.
