29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a.) HCF Management, Inc. dba Bradford Manor, various areas throughout the facility, on or about May 21st, 2021 and times prior thereto: Employees were required to wear N95 respirators (Including but not limited to: Makrite brand Sekura-N95 respirators) while providing direct patient care with suspected or confirmed COVID-19 positive residents. The employer did not develop and implement an updated worksite specific written respiratory protection program. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(e)(3)(i): The employer did not provide a follow-up medical examination for employees who gave a positive response to any question among questions 1 through 8 in Section 2, Part A of Appendix C, or whose initial medical evaluation demonstrated a need for a follow-up medical examination: a.) HCF Management, Inc. dba Bradford Manor, various areas throughout the facility, on or about May 21st, 2021 and times prior thereto: The employer did not provide a follow-up medical examination prior to fit testing and the required use of N95 respirators when the employee's initial medical evaluation demonstrated the need for a follow-up medical examination.
