29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On May 20, 2021, located on an exterior commercial roof structure, employees were exposed to a fall hazard installing roof curbs while wearing their harness with a lanyard that was not attached to the horizontal lifeline installed on the roof ridge. The potential fall height was measured to be 20 feet with a walking/working surface pitch of 3 in 12.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On May 20, 2021, located on an exterior commercial roof structure, the employer's designated competent person did not conduct an adequate inspection to ensure employees who were exposed to a fall hazard while installing roof curbs were anchored safely to the horizontal lifeline installed on the roof ridge. The potential fall height was measured to be 20 feet with a walking/working surface pitch of 3 in 12. The Metal Systems F&E, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1397868, citation number 1, item number 1a and was affirmed as a final order on 10-16-2019, with respect to a workplace located at 5410 Intrastate Drive, Fairborn, OH 45324.
