29 CFR  OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fall and struck-by hazards while working from an aerial lift extended over an open traffic lane.   (a) Jobsite located at 2400 E Huntingdon St, Philadelphia, PA:  On or about May 17, 2021, the employer failed to protect an employee against struck-by hazards in that an employee was spraying water onto a building under demolition while standing inside the platform of an articulating boom  lift that was positioned approximately 30 feet above a one-way urban street that was open to vehicular traffic.    Among other methods, feasible and acceptable means of hazard abatement include:  Following the national consensus standard requirements of the American National Standards Institute (ANSI) ANSI/ASSP A10.47-2015 for Work Zone Safety for Highway Construction, Section 4.11: 'Cranes and Aerial Lifts. If work involves crane operations or an aerial lift bucket or arm extending over an open traffic lane or shoulder, the area below the cranes boom, bucket or arm shall be closed to traffic and properly barricaded to protect workers.'

29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with the standards set forth in 29 CFR 1926 as evidenced by the violation(s) noted during the course of the inspection:  (a) Jobsite located at 2400 E Huntingdon St. Philadelphia, PA: The employer did not develop and implement a traffic safety control program to address, recognize, evaluate and control traffic hazards, thereby exposing employees to fall and struck-by hazards while working from an elevated aerial lift above an open traffic lane over a 6-hour period.   Condition noted on or about May 17, 2021.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   (a) Jobsite located at 2400 E Huntingdon St. Philadelphia, PA: On or about May 17, 2021, an employee was operating an articulating boom lift had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work, thereby exposing the employee to fall and struck-by hazards.
