OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease:  a) BUPA 108 LLC DBA Cogan Station Market located at 3725 Lycoming Creek Road, Cogan Station,  PA  17728:  On or about May 24, 2021, the employer did not develop and implement measures to mitigate the spread of SARS-CoV-2 the virus that causes COVID-19. Employees worked at the counter and cash register within 6 feet of unmasked customers and the employer did not require employees to wear face coverings, and did not implement physical distancing or install physical barriers.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED

Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:   a) Kitchen area, employees carried heavy containers, operated deep fat oil fryers, and cleaned cooking surfaces with chemical detergent which contained sodium hydroxide and did not wear closed toed shoes to provide protection against impact, thermal burns and chemical burns, on or about October 19, 2021.
