29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Employees are exposed noise at concentrations above of 85 dBA in a 8-hour time-weighted average (8-TWA).  At the jobsite located at 823 S. Ozark Girard, KS employees engaged in machining activities were exposed to  91.5 dBA, 89.9 dBA and 88.9 dBA in a 8-TWA an the employer did not administer a hearing conservation program.

Ozark Girard, KS employees engaged in machining activities at the following pieces of equipment throughout the facility were exposed to struck-by and amputation hazards in that machine guarding was not provided and utilized:  a)  All bandsaws, which sums a total of six, at the bandsaw area were not guarded at the point of operation.  b) All drill presses at drilling area, the rotating drill chuck was not guarded.
