29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling: a) Warehouse: On or about May 20, 2021, the employer exposed an employee to fall hazards, in that the use of fall protection was not enforced while the employee was working from a rug buggy platform with unprotected edges that was elevated by a "Clark" model S30L forklift (serial number S32L-0214-12000) to a height of approximately 9 feet above a concrete floor.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Warehouse: On or about May 20, 2021, and at times prior, the employer exposed employee(s) to struck-by and fall hazards, in that the employer provided rug buggy platforms for use as attachments to powered industrial trucks including, but not limited to, a "Clark" model S30L forklift (serial number S32L-0214-12000) to move product and elevate employees without obtaining prior written approval from the forklift manufacturer to use the rug buggy platforms as attachments.
