29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (a) Cornerstone Apartment Services, Inc., at 901 N Ogden Street, Denver, CO: On and preceding 5/26/2021, the employer did not ensure that any employee using a respirator voluntarily was provided with the information contained in Appendix D to 29 CFR 1910.134. An employee performed work at a construction site. The employer allowed the employee to voluntarily wear a tight fitting air purifying respirator when the work area was dusty. The employer did not ensure that all employees voluntarily using a respirator were provided the information in Appendix D. This condition exposed the employee to a respiratory hazard.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Cornerstone Apartment Services, Inc., at 901 N Ogden Street, Denver, CO: On and preceding 5/26/2021, the employer did not ensure that any employee using a respirator voluntarily was medically able to use that respirator. An employee performed work at a construction site. The employer allowed the employee to voluntarily wear a tight fitting air purifying respirator when the work area was dusty. The employee did not receive a medical evaluation to determine if he was medically able to use the respirator. This condition exposed the employee to a respiratory hazard.

Cornerstone Apartment Services, Inc. directed the work of electrical, plumbing, demolition, and concrete contractors during the remodeling of an apartment building. The employer did not ensure that a competent person performed frequent and regular inspections of the jobsite. This condition exposed an employee of Cornerstone Apartment Services, Inc. and employees of other employers to electrical, respiratory, and other construction related hazards.
