29 C.F.R. � 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On May 25, 2021, and times prior thereto, the employer did not provide the medical evaluation to an employee to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator N95 in the workplace.
