29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  (a) Pagett Electric Company, at 901 N Ogden Street, Denver, CO: On and preceding 5/25/2021, the employer did not ensure that any employee using a respirator voluntarily was medically able to use that respirator.  Employees performed work at a construction site.  The employer allowed the employees to voluntarily wear tight fitting air purifying respirators when the work area was dusty.  The employees did not receive medical evaluations to determine if they were medically able to use a respirator.  This condition exposed the employees to a respiratory hazard.

29 CFR  1926.403(i)(2)(i): Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by cabinets or other forms of enclosures, nor by any of the means listed in subparagraphs (A) through (D) of this paragraph:   (a)  Pagett Electric Company, at 901 N Ogden Street, Denver, CO: On or about 5/25/2021 and 5/26/2021, the employer did not ensure that live parts of electric equipment operating at 50 volts or more were guarded against accidental contact by cabinets or other forms of enclosures.   The covers of electrical panels were removed to enable tapping into the panel to provide power for temporary work lighting.  The covers were not replaced.  This condition exposed employees to an electrical hazard.
